Railroad Accident Victim files Personal Injury Claims

Los Angeles, California, June 6, 2007 - Laura was riding as a passenger in the left
side of a Ford Explorer’s rear part. The train struck the vehicle as it was heading
west and crossing the railroad grade crossing on Meramec Terrace Road in Franklin.

Laura suffered closed injuries in the head, infractions, hemorrhage and contusions
in the brain, multiple fractures of the skull base, extensive fractures in the face,
fractures in the ribs and pelvis, multiple injuries in the internal organ and soft
tissues including a lacerated liver and spleen, and rupture in the diaphragm that
caused her stomach’s herniation into her left hemi-thorax. She also suffered from
anemia due to massive blood loss and hemorrhagic shock the suit states along with
medical evidence.

Steven and Gail Warren, parents of Laura, claimed that the railway company had been
negligent in their railroad operations. Their negligence is the cause for their
failure to blow the train’s horn properly in order to warn vehicles of an
approaching train.

The personal injury lawsuit was filed last May 25 and named the Samuel S. Williams,
the engineer of the train that struck the Ford Explorer, as defendant.

Lawsuit papers claimed that Williams failed to blow the required sequence of the
train’s emergency horn. Furthermore, Williams did not engage the train’s emergency
brakes properly.

The lawsuit claims further stipulated that the railroad crossing had inadequate
sight distance for an approaching train. This is another that contributed to the
collision accident between the train and car. According to the papers, they railway
company did not clear the visibility obstructions in order to give motorists an
adequate view of two directions in the railroad tracks. It is a violation on the
state of Missouri’s railroad tracks law.

The personal injury lawsuit claims are filed in two counts and seek monetary awards
of more than $100,000 for punitive damages and compensation.
